You might be aware that since 2013 and the introduction of employment tribunal fees, employers have been used to operating in a fairly benign tribunal litigation risk environment. Put simply, after 2013, fees for bringing employment tribunal claims meant that far fewer employees actually sued their employers.

That all changed in July 2017 when the Supreme Court effectively abolished employment tribunal fees. Businesses can therefore expect the risk of receiving employment claims to be far higher in future than in recent years.
